It is required by law that any student with an IEP (<a href=\"https:\/\/wp.lps.org\/pedia\/2009\/08\/20\/504-ie-section-504-504-plans\/\">504 Plan<\/a>) must have a <strong>manifestation meeting<\/strong> at his\/her home school before being referred to Student Services due to behavioral incidents.<\/p>\n<p>At the manifestation meeting, the team examines the impact that the student\u2019s disability may or may not have had on an offending incident. If the student\u2019s actions are determined to be a manifestation of his\/her disability, then the maximum disciplinary action taken is a five- day suspension.<\/p>\n<div class=\"page\" title=\"Page 71\">\n<div class=\"section\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p><a href=\"https:\/\/nebraskalegislature.gov\/laws\/statutes.php?statute=79-265.01\">Nebraska State Statute 790265.01<\/a> (LB705) states that suspension is prohibited for students pre-kindergarten through second grade, with limited exceptions.<\/p>\n<p>The Individuals with Disabilities Education Act (IDEA) requires schools to make necessary accommodations for students with disabilities to ensure they are provided a Free Appropriate Public Education (FAPE).<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Through their Individual Education Plan (IEP), a student may have an adjusted plan for behavior and discipline.
